H-1B Petitions for Skilled Workers in Specialty Occupations Subject to FY 2007 Cap
On April 1, 2006, employers may begin filing H-1B petitions for skilled workers in specialty occupations subject to the FY 2007 cap. Any such position would have an employment start date of October 1, 2006.

Filing the H1B petition as soon as possible after April 1st will be crucial for any employer intending to hire an H-1B employee. Last year, FY 2006, the cap was reached on August 10, 2005 and employers have been precluded from filing since that date. (The annual cap does not apply to all employers). For example, for an employer hoping to hire a student currently in F-1 status, it will be essential to start the H1B process as soon as possible after April 1 in order to insure that that student will receive timely H-1B approval and have a seamless adjustment from F to H.

As noted in articles below, an H-1B specialty occupation requires specialized knowledge along with at least a bachelor's degree or its equivalent in fields such as architecture, engineering, mathematics, physical sciences, social sciences, medicine and health, education, business specialties, accounting, law, theology, and the arts.
