Guardianships
Guardianship is the process by which a court declares an individual to be an incapacitated person and appoints a surrogate decision maker for them. Our attorneys have significant experience before the Orphans’ Court of Philadelphia and numerous other counties in Pennsylvania and New Jersey representing hospitals, long term care facilities, and private individuals in guardianship matters, including representation of the alleged incapacitated person. We understand the role and duties of the guardian intimately as well as the health care and risk management side of guardianship practice. We also understand the importance of avoiding guardianship if one is not necessary, and can assist with effectuating less restrictive alternatives where appropriate.
